Sean “Diddy” Combs is asking a federal judge to dismiss the explosive sexual assault, trafficking and extortion lawsuit filed against him by music producer Rodney “Lil Rod” Jones after the sexual assault and trafficking lawsuit Diddy facilitated with his ex-girlfriend Casandra “Cassie” Ventura within 24 hours last year.
In a new motion to dismiss filed Monday in Manhattan federal court, Didi's attorneys called the latest 98-page version of Jones' complaint “vague,” “shameless” and excessive. Jones, who collaborated with Combs on the Grammy Award, is being sued Love album from September 2022 to the end of 2023, he is attempting to “dress up a major trade dispute as a diabolical RICO conspiracy” and should be stopped without having to try again. (Jones filed his first complaint in February and amended it twice before recently agreeing to drop music giant Universal Music Group as a defendant.)
“Despite all his exaggeration and crazy theatricality, h [second amended complaint] fails to state a single viable claim against any of the Combs defendants,” the new filing states. “Filled with legally meaningless claims and blatant lies, SAC's true purpose is to create media hype and exploit it to extract a settlement.”
Combs and his attorneys contend that Jones lacks standing to bring an extortion claim because they argue that a breach-of-contract claim for alleged non-payment does not qualify as the necessary “charged act.” They also argue that Jones's trafficking claim should fail because, in their view, he failed to show that he was subjected to “threats of violence, coercion fraud.”
Deedy and his legal team also claim that Jones is being too “vague” in the lawsuit's allegations that he was subjected to “continuous unsolicited and unauthorized searches and groping of his anus.” They say Jones is required to prove “the where, when and how of the alleged misconduct” and fails to offer evidence of “any conversation, report or witness to any specific incident.”
The federal judge overseeing the case is not expected to rule on the motion anytime soon. Jones will have an opportunity to respond in writing first. Meanwhile, Jones' attorney, Tyrone Blackburn, said Monday that Combs could have filed an affidavit to support his plea, but did not. He also pointed out that Combs was the subject of a raid by federal authorities in March.
“This is nothing more than a pricing exercise by Sean Combs' latest team of lawyers. It's a feeble attempt to line their pockets before he's indicted and they decide to kick his ass like his five previous lawyers did,” Blackburn said in a statement. “I choose my clients. I don't choose their facts. Rodney Jones submitted an affidavit under penalty of perjury to the truth of the matter asserted in the affidavit. Can Sean Combs do the same?'
In his lawsuit, Jones alleges that Combs subjected him to unwanted sexual intercourse and also secretly drugged and forced him to solicit and engage in sexual intercourse with sex workers. Jones claimed to have physical evidence for some of his accusations, including video footage. “Mr. Combs demanded that Mr. Jones constantly record him,” Jones' lawsuit alleges. “As a result, Mr. Jones has secured hundreds of hours of footage and audio of Mr. Combs, his staff and his guests engaging in serious illegal activity.”
In a related sexual assault lawsuit filed against Combs' son Christian “King” Combs by flight attendant Grace O'Marcaigh, Combs is named as a co-defendant, in part because he chartered the yacht where the alleged assault took place in 2022 .Jones claimed to have recordings of the alleged assault involving O'Markai. (NBC News posted part of this audioalthough the broadcaster noted that it had not verified who was speaking.)
Jones also accused Combs' associate Brendan Paul of being a drug “mule” who allegedly obtained and distributed “drugs and guns” for the music mogul. During Homeland Security raids on Combs' properties in March, Paul was arrested and charged with possession of cocaine. Paul pleaded not guilty, later accepting a plea deal in which he agreed to complete a drug diversion program, after which his case would be dismissed.
Also named as defendants in Jones' lawsuit are Combs' chief of staff Kristina Khorram and Justin Combs, his 30-year-old son with stylist Misa Hylton. City Girls rapper Yung Miami and actor Cuba Gooding Jr. were named and pictured with Jones in the court documents. Jones is the first man to accuse Combs of sexual harassment and misconduct. He is one of nine people who have filed sexual assault lawsuits against Combs since November 2023.
