The man who hit Bebe Rexha in the face with his flying phone at a concert in New York last summer may get away with just 40 days of community service for the attack.
During a recent court hearing, Nicholas Malvagna accepted an offer from the court that his charges be dismissed if he completes 40 days of community service and does not violate a protection order for 6 months, Rolling rock has learned.
At a Feb. 9 compliance hearing, Malvagna informed the court that he had served community service and was offered an opportunity by the Manhattan District Attorney to “move for a deferment pending dismissal,” or ACD, according to the Manhattan DA's office.
An ACD allows a person's charges to be dropped after six months, as long as they have not been arrested during the agreed period. Malvagna's bid includes a final six-month protection order.
“This resolution, reached after extensive negotiations, allows Mr. Malvagna to contribute to the community while ensuring that the criminal charges are dismissed and sealed,” Malvagna's attorney said. Rolling rock. Malvagna's next trial is set for June 20.
A representative for Rexha did not immediately respond Rolling rockhis request for comment.
Last June, Malvagna was charged with two counts of third-degree assault, one count of second-degree harassment, one count of second-degree aggravated harassment and one count of attempted third-degree assault. At the time, Rexha received stitches and Malvagna was arrested after punching the singer in the face during her set at New York's Pier 17.
A preliminary investigation by the NYPD “found that a 27-year-old male intentionally threw a cell phone” at the 33-year-old star. Rexha was treated by EMS and transported to a local hospital, where she received stitches.
According to the Manhattan District Attorney's office, Malvagna not only admitted to throwing the phone, but also stated, “I was trying to see if I could hit her with the phone at the end of the show because it would be funny.”
The incident happened near the end of Rexha's show celebrating her self-titled album Bebe. The next day, she posted a photo of herself on Instagram with the caption, “I'm fine,” referring to her successful collaboration with David Guetta.
