Don Henley has filed a lawsuit seeking the return of personal Eagles lyric sheets that were recently the subject of a separate criminal trial.
While charges against former Rock & Roll Hall of Fame curator Craig Inciardi and rock memorabilia dealer Edward Kosinski were suddenly dropped during the trial in March, the Eagles singer filed a lawsuit Thursday to regain ownership of the seized lyric sheets , including handwritten lyrics from Hotel California time.
“Don Henley has filed a lawsuit today in New York federal court seeking the return of his stolen property—his private handwritten notes and lyrics to his iconic songs Hotel California album,” Henley's attorney Daniel Petrocelli said in a statement to Rolling rock.
“These 100 pages of personal lyric sheets belong to Mr Henley and his family and he has never authorized the defendants or anyone else to traffic them for profit.”
Inciardi, Kosinski and rare book dealer Glenn Horowitz (who was not named in Henley's lawsuit) each faced criminal charges of conspiracy to possess stolen property in connection with the attempted auction of the lyrics, which the trio acquired from author Ed Sanders. Saunders received the lyrics decades earlier, while writing an Eagles book that was never completed, and simply never returned the lyrics to Henley and the late Glenn Frey.
Since the surprising conclusion of the criminal trial, the lyrics have remained in the custody of the District Attorney of New York (DANY), pending a decision on their rightful owner. In the lawsuit filed Thursday, which he secured Rolling rockHenley makes his case for the return of lyrics.
“Because Kosinski and Inciardi have falsely claimed ownership of Henley's sheet music, a declaration by this Court that Henley is the rightful owner is required to provide “satisfactory evidence of his title'' and facilitate the return of his sheet music. Henley from DANY to Henley. states a lawsuit.
“Because Kosinski and Inciardi have also claimed title to Henley's lyrics, the matter must be decided in a civil court of appropriate jurisdiction.”
Henley “demands a jury trial on all issues so potent,” added the lawsuit, which comes three months before the Eagles begin their residency at the Sphere.
